Required Lease Disclosures
Review the lease disclosures a Wyoming landlord must make:
- Lead-Paint Disclosure: A landlord should disclose whether a building was built before 1978 and provide materials on the risks of exposure to lead-based paint that these buildings may contain. [1]
- Notice of Non-Refundable Deposit: A landlord must specify whether a deposit is non-refundable in the lease agreement. [2]
Security Deposit
- Maximum Amount: No maximum.
- Receipts: Not required.
- Interest Payments: Not required.
- Bank Account: Not required.
- Returning Requirements: The landlord must refund the deposit within 15 days after receiving the tenant’s new mailing address or 30 days after the lease ends, whichever is later. [3]
- Withholding Rules: The tenant must receive a written list itemizing all damages and amounts withheld. [3]
Rent Payments
- Laws: Rent is due on the date specified in the lease.
- Rent Control: There are no rent control laws in Wyoming. Cities and towns may be able to impose their own requirements.
- Late Fees and Grace Period: State law doesn’t impose a maximum late fee amount, nor does it have a grace period for tenants to pay overdue rent. Once rent is due, the landlord can issue a 3-day notice to quit for non-payment.
- Withholding Rent: Tenants may not withhold rent as a remedy.
Landlord Right of Entry
- Notice Requirements: A landlord doesn’t need to provide prior notice before entering the rented property. It’s recommended to do so anyway.
- A tenant shouldn’t deny reasonable entry, as they must allow the landlord to enter the property to show the property to prospective buyers, make repairs, or perform an inspection. [4]
Property Repairs
- Landlord Responsibilities: Landlords must only rent a property if it’s reasonably sanitary, safe, and fit for human occupancy. They must also maintain electrical systems, hot and cold water, plumbing, and heating. [5]
- Tenant Repairs: Tenants must maintain the dwelling unit in a safe and clean condition, not unreasonably burden common areas, dispose of all waste in a clean manner, and comply with all lawful requirements of the lease. [6]
- Abandonment: A landlord dealing with a tenant who breaches their duties can send out a 3-day notice to quit for non-compliance. [7]
Terminating a Lease
- Month-to-Month Tenancy: State law doesn’t specify a notice period for ending a month-to-month lease, but it’s still common courtesy to issue a lease termination notice.
- Unclaimed Property: The tenant has seven days to respond to a landlord’s notice of personal property left behind. After this notice period, the landlord can dispose of it. [8]
